Edmonton Real Estate Lawyers
Edmonton real estate lawyers are the men and women lawyers of Edmonton who handle the real estate transactions in and around Edmonton. Sometimes real estate "lawyers" are referred to as real estate "attorneys" although this is generally considered more of a USA term.
In most residential purchase situations the real estate lawyers get involved after the realtors are done with the parties and an offer to purchase a property has been concluded. The buyer and the seller each get their own lawyer and the transaction proceeds from there. In mortgage refinancing situations the mortgage lawyer often acts for both the borrower and the lender. This happens as well with second mortgages or lines of credit secured by mortgages. Special care needs to be taken in situations involving the Com Free Private real estate system where there is "no realtor".
The primary job of the buyer’s lawyer is to ensure that the buyer gets their name on the property. The primary job of the seller’s lawyer is to ensure that the seller gets their money. The bank, if there is one, will often use the buyer’s lawyer as well and the primary job on behalf of the bank is for the lawyer to ensure that the bank’s mortgage or other security documentation gets properly signed and registered against the property.
Edmonton real estate lawyers do much more than the “standard” purchase described above. They must have a deep and really varied knowledge of the law. They must be familiar with both federal and provincial laws. The Land Titles Act of Alberta is one of these laws and this legislation alone has more than 200 sections plus regulations and a procedures manual.
All lawyers in Alberta must be members of the Law Society of Alberta, which is the governing body for the lawyers in Alberta. Gary Ewasko has been a Law Society member in good standing since 1987.
